The budget program "Humanitarian Demining" is implemented in accordance with the Procedure for the Use of Funds Provided in the State Budget for Humanitarian Demining, approved by Resolution of the Cabinet of Ministers of Ukraine dated March 12, 2024 No. 284.

The main administrator of budget funds and the responsible executor of the budget program is the Ministry of Economy, Environment and Agriculture of Ukraine (hereinafter referred to as the Ministry of Economy). The practical implementation of the program is ensured by the budgetary institution «Center for Humanitarian Demining» (hereinafter referred to as the Center), which is a lower-level administrator of budget funds.

The program is financed from the state budget, in particular by attracting funding within the framework of the Ukraine Facility in accordance with the Framework Agreement between Ukraine and the European Union.

The purpose of the program. The goal of the program is to restore the safe use of agricultural lands by funding humanitarian demining and returning the lands to safe economic use.

 The Humanitarian Demining Budget Program covers:

  • 100% covering the costs of humanitarian demining of agricultural lands. The state fully finances the humanitarian demining of agricultural land plots that have not yet been cleared. The Center purchases services through the Prozorro electronic system.
  • 80% compensation for humanitarian demining costs. The applicant submits an application for compensation for the costs of humanitarian demining of agricultural lands that were demined in the period from February 24, 2022 to April 15, 2024 and a package of documents confirming its demining to the Center's email address. The Center transfers these documents to the commission for consideration of issues related to the provision of compensation for the costs of humanitarian demining of agricultural lands, which is formed by the Ministry of Economy. Based on the results of consideration of these documents, the commission provides the Center with a proposal and recommendation on the provision or refusal of compensation. After that, the Center ensures the implementation of the decision made.

The following can participate in the program:

  • agricultural producers - legal entities and individual entrepreneurs;
  • individuals who produce agricultural products without creating a legal entity;
  • business companies, 100% of whose shares belong to the state, regarding state-owned agricultural land plots transferred to them for use.

Implementation mechanism:

  1. Submitting an application. The application is submitted through the State Agrarian Register. In cases provided for by Order No. 284, individuals may submit documents through the relevant military administrations or local government bodies.
  2. Comprehensive check. Before announcing the procurement, the Center conducts a comprehensive check of the applicant's documents and the land plot. In particular, the following are checked:
  • the right of ownership or use of a land plot;
  • compliance of the land plot with the requirements of Order No. 284;
  • the presence of confirmation of actual or probable contamination of the territory;
  • the possibility of carrying out work taking into account the security situation;
  • lack of grounds for refusing to provide compensation.

During the inspection, the Center uses information from state registers and receives information from state authorities.

Before announcing the procurement of demining works, the Humanitarian Demining Center conducts a comprehensive check of the applicant and the land plot. To do this, at the request of the Center:

  • The Mine Action Center confirms information about whether the land plot is contaminated or suspected of being contaminated with explosive objects;
  • The State Geocadastre provides information about the cadastral number, area, location, intended purpose and right to use the land plot;
  • The State Tax Service provides information on the presence or absence of tax debt.
  • The Center verifies the right of ownership or use of a land plot through the State Register of Real Property Rights;
  • The Center checks information about the applicant's state registration and the relevance of his registration data through the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Organizations.

Only after confirming the applicant and the land plot meet the requirements of Procedure No. 284, the Center makes a decision to announce the procurement in the Prozorro electronic system. Payment for the work performed is made after confirmation of its completion, quality control, and execution of the necessary documents.

To participate in the program, the farmer must meet the established criteria:

  • not be under NSDC sanctions;
  • not have any tax debt as of the 1st of the month preceding the month of application submission;
  • not be subject to EU restrictive measures;
  • not to have citizens of the aggressor state among the ultimate beneficial owners;
  • not be in bankruptcy or liquidation;
  • not be associated with a certified PMD operator with whom a demining contract has been concluded.

Procurement of demining services:

  • The Center begins preparations for announcing the auction within 5 days after sending a notification of acceptance of the application to the agricultural producer, partnership, or agricultural product producer.
  • The expected cost of purchasing demining services (the starting price of the auction) is calculated by the Center in accordance with methodological recommendations approved by the Ministry of Economy.
  • Procurement is carried out through public competitive bidding on the Prozorro platform in accordance with current legislation.
  • Any certified PMD operator can participate in the bidding.
  • The winner is determined based on the results of the procurement.
  • When determining the winner of the auction (the PMD operator with the lowest justified price offer), it is also checked whether he is a related party to the applicant. If such a fact is found, the offer of such operator is rejected, and the next bidder is recognized as the winner.
  • After passing the necessary checks, a contract for the performance of humanitarian demining services is concluded with the winner of the tender.
  • The Center sends the applicant a certified copy of the contract and informs about it in the DAR's personal electronic account.
  • Based on contracts, the Center forms a submission on the implementation of compensation within the monthly allocation plans of the general and special funds of the state budget, taking into account the relevant actual revenues to the special fund of the state budget, by the 25th of each month.

Demining work and payment for services:

  • The PMD operator begins work within 5 business days after receiving a notification from the bank about reserving funds for the provision of demining services.
  • After completion of demining, the PMD operator provides the Center with the necessary documents, including a copy of the territory clearance certificate or a guarantee letter for the territory released according to the results of a non-technical survey.
  • The center checks the documents and, after signing, sends their certified copies to the bank and the applicant.
  • Based on the results of the inspection, the Center transfers funds to the PMD operator within one working day in the amount of the actual costs incurred for demining agricultural land plots.

The funds are transferred by the Center directly to the mine action operator from an off-budget account opened with the bodies of the State Treasury Service of Ukraine, in accordance with Procedure No. 284.
